By placing an order through our online store, you agree to these Terms and Conditions.
These Terms and Conditions apply to consumers and entrepreneurs unless an individual provision expressly provides otherwise.
2. Contracting Party
The purchase contract is concluded between you and:
Modevia
Rico Di Natali
Karlsbrunner Straße 135a
66333 Völklingen
Germany
Email: modeviaclothing@gmail.com
3. Products and Product Descriptions
We make every effort to display our products, descriptions, colors, sizes and images as accurately as possible.
Please note that the appearance of colors may vary depending on your device and screen settings. Minor differences between product images and the actual product do not constitute a defect where they are technically unavoidable.
The essential characteristics of each product are described on the respective product page.
4. Prices and Payment
All prices displayed in our online store are stated in euros (€).
Unless otherwise stated, the prices include applicable statutory VAT.
Any additional delivery costs will be clearly displayed during the ordering process before you place your order.
We offer the payment methods displayed during the checkout process. The available payment methods may vary depending on the customer's location and other factors.
The purchase price is due immediately upon conclusion of the contract unless otherwise stated for the selected payment method.
5. Placing an Order and Contract Formation
The presentation of products in our online store does not constitute a legally binding offer.
By clicking the order button, you submit a binding offer to purchase the products in your shopping cart.
Before submitting your order, you have the opportunity to review and correct your order details.
The contract is concluded when we accept your order. Acceptance may occur by sending you an order confirmation by email or by dispatching the ordered goods, whichever occurs first.
We will send you an order confirmation containing the details of your order to the email address you provided during checkout.
If a product is unavailable after you have placed your order, we will inform you as soon as possible and refund any payment already made for that product.
6. Delivery
We deliver to the countries and addresses made available during the checkout process.
Delivery times are stated on the respective product page or during checkout and are estimates unless expressly agreed otherwise.
If an ordered product cannot be delivered due to circumstances for which we are not responsible, we will inform you without undue delay.
Partial deliveries are permitted where this is reasonable for you. Any additional shipping costs resulting solely from partial deliveries will be borne by us.
For consumers, the statutory provisions regarding the transfer of risk apply.
7. Retention of Title
The goods remain our property until the purchase price has been paid in full.
8. Statutory Defect Rights
Statutory rights in the event of defects apply.
If the delivered goods are defective, you are entitled to the remedies provided by applicable law, including repair or replacement and, where the legal requirements are met, a reduction of the purchase price or withdrawal from the contract.
Nothing in these Terms and Conditions limits your mandatory statutory rights as a consumer.
9. Warranty
The statutory warranty provisions apply.
We are not responsible for defects caused by improper use, improper handling, normal wear and tear, or damage occurring after delivery for reasons attributable to the customer, to the extent permitted by applicable law.
10. Liability
We are liable without limitation for damages resulting from:
-
injury to life, body or health caused by a negligent or intentional breach of duty by us or our legal representatives or agents;
-
intentional or grossly negligent breaches of duty;
-
liability under mandatory statutory provisions, including applicable product liability laws;
-
guarantees expressly given by us.
In cases of slight negligence, we are liable only for the breach of essential contractual obligations whose fulfillment is necessary for the proper performance of the contract and on whose compliance you may generally rely.
In such cases, liability is limited to the foreseeable damage typical for the contract.
The above limitations do not apply where mandatory statutory liability provides otherwise.
11. Intellectual Property
All content available through our online store, including photographs, product images, logos, graphics, texts, designs and other materials, is protected by applicable intellectual property laws.
Unless expressly permitted by us or required by law, such content may not be reproduced, distributed, modified, published or commercially used without our prior written consent.
12. Customer Accounts
If you create a customer account, you are responsible for providing accurate information and keeping your login details confidential.
You must notify us promptly if you become aware of unauthorized access to your account.
We reserve the right to suspend or terminate customer accounts where there is a material breach of these Terms and Conditions or where continued use of the account would be unlawful.
13. Promotions and Discount Codes
Promotional offers and discount codes may be subject to additional conditions, which will be communicated with the respective promotion.
Unless expressly stated otherwise, discount codes cannot be combined with other promotions and cannot be exchanged for cash.
We reserve the right to cancel or refuse a discount code where there is reasonable evidence of misuse, fraud or technical abuse.
14. Availability of the Online Store
We aim to keep our online store available at all times.
Temporary interruptions may occur due to maintenance, technical problems, security measures or circumstances beyond our reasonable control.
There is no entitlement to uninterrupted availability of the online store.
15. Data Protection
We process personal data in accordance with applicable data protection laws.
Further information about how we collect, use and protect personal data can be found in our Privacy Policy.
16. Right of Withdrawal
Consumers generally have a statutory right of withdrawal of 14 days.
The conditions, procedure and consequences of exercising the right of withdrawal are set out in our separate Withdrawal Policy.
The statutory exceptions to the right of withdrawal apply where legally applicable.
Nothing in these Terms and Conditions limits or excludes your statutory right of withdrawal.
17. Returns and Refunds
If you validly exercise your statutory right of withdrawal, we will process the refund in accordance with the applicable statutory provisions.
Unless otherwise required by law, the customer is responsible for the direct cost of returning the goods after exercising the right of withdrawal.
We may withhold reimbursement until we have received the returned goods or until you have provided evidence that the goods have been returned, whichever occurs first, where permitted by law.
18. Force Majeure
We are not responsible for delays or failures to perform contractual obligations caused by circumstances beyond our reasonable control, including natural disasters, war, governmental measures, strikes, significant disruptions to transportation, failures of suppliers or other comparable events.
This does not affect your statutory rights as a consumer.
19. Changes to These Terms and Conditions
We may update these Terms and Conditions from time to time where this is necessary due to changes in legal requirements, our services or other legitimate reasons.
The version applicable at the time of your order shall apply to your purchase contract.
20. Consumer Dispute Resolution
The European Commission previously provided an online dispute resolution platform (ODR platform). The platform was discontinued on 20 July 2025.
We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board unless such an obligation arises from applicable law or we have expressly agreed to participate.
Where required by law, we will provide the relevant information regarding consumer dispute resolution.
21. Applicable Law
German law applies, subject to mandatory consumer protection provisions of the country in which the consumer has their habitual residence where such provisions are applicable.
The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
22. Jurisdiction
For consumers, the statutory rules regarding jurisdiction apply.
If the customer is a merchant, a legal entity under public law or a special fund under public law, or if the customer has no general place of jurisdiction in Germany, the place of jurisdiction for all disputes arising from the contractual relationship shall be the registered business address of Modevia, to the extent legally permissible.
23. Severability
If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
Mandatory statutory provisions shall apply in place of any invalid or unenforceable provision.
24. Contact

Statutory consumer rights remain unaffected by these Terms and Conditions.
